Addendum Agreement for .BID

1. You agree that you will not engage in any of the following activities with respect to your registered domain name(s): (a) distributing malware, (b) abusively operating botnets, (c) phishing, (d) piracy, (e) trademark or copyright infringement, (f) fraudulent or deceptive practices, or (g) counterfeiting or otherwise engaging in activity contrary to applicable law. You agree that if you are found to have engaged in any of the aforementioned activities, your account and any domain name(s)s associated with any of these prohibited activities are subject to immediate suspension with or without notice to you. You further agree that the RO reserves the right to take action necessary to deny, cancel, suspend, lock, or transfer your domain name registration for violation of this paragraph 1.

 

2. You agree to indemnify, defend and hold harmless the Registry Operator (referred to as either “Dot Bid Limited” or “RO") and its subcontractors (including the Registry Operator’s back-end services provider) and their respective directors, officers, employees, affiliates and agents from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses arising out of or relating to your domain name registration except in instances of the Registry Operator’s negligence, error, or omission. This indemnification obligation shall survive the termination or expiration of this Addendum agreement.

 

3. You agree to comply with and remain in compliance with the following during the term of your domain name registration:

a. All ICANN standards, policies, procedures, and practices for which the RO has monitoring responsibility in accordance with our agreement with the RO or pursuant to any arrangement between the RO and ICANN.
b. All operational standards, policies, procedures and practices of the RO, as establishes by the RO from time to time, including but not limited to the RO’s acceptable use policy, which sets forth the types of activity that define abuse, and which sets forth the RO’s rights to take appropriate action in instances of domain name abuse.

 

4. You agree, understand, and acknowledge that we collect certain personal information about you for the registration of your domain name. This information consists of any and all identifiable information about the registrant of the domain name (“Personal Data”). You hereby consent to the collection and use of your Personal Data for the purposes of completing your domain name registration, including but not limited to the displaying of your Personal Data on any WHOIS query. You also consent to the use of your Personal Data by the RO for the following purposes:

a. for statistical research;
b. for the day to day operations of the RO, including email contact by the RO as required by the RO’s acceptable use policy;
c. for the benefit of the RO’s service providers which may provide legal, accounting, delivery, installation, system support, escrow, marketing, clearinghouse, and other services of the behalf of the RO;
d. for law enforcement agencies or to comply with a court order or other compulsory operation of law applicable to the RO; and
e. as may be required by ICANN in accordance with a zone file access request.
